User Agreement for Shume

Effective Date: November 7th , 2024

Introduction

Welcome to Shume! This User Agreement ("Agreement") is a legally binding contract between you ("User" or "you") and Shume ("we", "us", "our"). By accessing or using the Shume mobile application or its services, you agree to comply with and be bound by this Agreement. Please read it carefully before using the app.

If you do not agree to any of the terms set forth in this Agreement, you must discontinue using Shume immediately.

1. Use of the App

2. User Conduct

While using Shume, you agree not to:

Post, share, or transmit any content that is harmful, illegal, defamatory, abusive, harassing, vulgar, hateful, or otherwise objectionable.
Infringe on the intellectual property rights, privacy, or other rights of third parties.
Upload, share, or transmit any viruses, malware, or harmful software that could damage or disrupt Shume or other users.
Attempt to gain unauthorized access to any part of Shume, including user accounts or systems.
Engage in spamming, phishing, or any other activities that might interfere with the normal functioning of Shume.

3. Content and Intellectual Property

Shume allows users to share content. By sharing content, you agree to the following:

User-Generated Content: You retain ownership of any content you post, but you grant Shume a non-exclusive, worldwide, royalty-free license to use, display, modify, and distribute your content within the app for the purpose of operating and improving the platform.
Prohibited Content: You agree not to upload or post any content that violates any laws, including but not limited to copyright, trademark, or privacy laws.
Copyright Infringement: If you believe your intellectual property rights are being infringed, you may contact us at kbkyshop@outlook.com with detailed information for review.

4. Account Termination

We reserve the right to suspend or terminate your access to Shume without notice if you violate any terms of this Agreement or if your actions put Shume, its users, or its partners at risk. You may also terminate your account at any time by contacting us at kbkyshop@outlook.com .

Upon termination of your account, any licenses or rights granted to you under this Agreement will immediately cease.

5. Privacy and Data Protection

Your privacy is important to us. By using Shume, you acknowledge that you have read and agree to the terms of our Privacy Policy, which explains how we collect, use, and share your information. 6. Updates and Modifications

Shume reserves the right to modify or update this Agreement at any time. If we make significant changes to the Agreement, we will notify you by updating the "Effective Date" above and may provide additional notice via email or within the app. Your continued use of the app after any changes are made constitutes your acceptance of the updated Agreement.

7. Third-Party Services and Links

Shume may include links or access to third-party websites, apps, or services. We do not control or endorse any third-party content, services, or practices. You agree that Shume is not responsible for the availability, accuracy, or legality of external services and that your use of any third-party services is at your own risk.

8. Disclaimer of Warranties

Shume is provided "as-is" and "as available," without warranties of any kind, either express or implied. We do not warrant that:

The app will meet your requirements or be available on an uninterrupted, secure, or error-free basis.
The results or information obtained from using the app will be accurate, reliable, or complete.
Any defects or errors in the app will be corrected.

To the fullest extent permitted by law, Shume disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, Shume, its affiliates, and its service providers shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from or in connection with your use of Shume. This includes, but is not limited to, any errors, omissions, interruptions, or loss of data.

In no event will Shume’s total liability to you exceed the amount you have paid (if any) to use the app in the 12 months preceding the event giving rise to the liability.

10. Indemnification

You agree to indemnify, defend, and hold harmless Shume, its affiliates, partners, and employees from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of Shume, your violation of this Agreement, or your infringement of any third-party rights.

11. Governing Law and Dispute Resolution

This Agreement is governed by and construed in accordance with the laws of [Jurisdiction, e.g., the State of California], without regard to its conflict of law principles.
